1. Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and The Burton Method ("TBM," "we," "us," or "our"). By accessing or using our website at burtonmethod.com, app.burtonmethod.com, or any related services (collectively, the "Service"), you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

You must be at least 18 years old to use the Service. By using the Service, you represent that you are at least 18 years of age.

2. Definitions

  • "Service" — The Burton Method platform, including the website, web application, API, and all features and content accessible through them.
  • "Content" — All materials provided through the Service, including video lessons, transcripts, study tools, quizzes, explanations, and interactive learning materials.
  • "LSAC Licensed Content" — LSAT questions, answer choices, passages, and related materials used under license from the Law School Admission Council (LSAC).
  • "AI-Generated Content" — Study materials, Learn Stream cards, practice questions, and other educational content generated using artificial intelligence.
  • "Subscription" — Your paid access plan to the Service.
  • "User Data" — Information you provide to us or that is collected through your use of the Service.

3. Account Terms

To access most features of the Service, you must create an account. When you create an account, you agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain and promptly update your account information to keep it accurate.
  • Keep your password confidential and not share your login credentials with anyone.
  • Notify us immediately at support@burtonmethod.com if you suspect unauthorized access to your account.
  • Accept responsibility for all activity that occurs under your account.

Your account is for your personal use only. You may not share, transfer, sell, or otherwise allow any other person to access your account. Each individual using the Service must have their own account. Violation of this policy may result in immediate account termination.

We reserve the right to suspend or terminate accounts that violate these Terms, including accounts that appear to be shared or used by multiple individuals.

4. Subscriptions & Billing

The Service offers paid subscription plans. By subscribing, you agree to the following:

Pricing. Current pricing is displayed on our pricing page. We reserve the right to change pricing with at least 30 days' advance notice before your next billing cycle.

Auto-Renewal. Monthly subscriptions automatically renew at the end of each billing period. By subscribing, you expressly authorize us to charge your payment method on a recurring basis until you cancel. You will receive a reminder before each renewal.

Lifetime Plans. One-time payment plans grant access for the lifetime of the Service and do not auto-renew.

Cancellation. You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service through the end of your current billing period. No partial-period refunds are issued for cancellations.

Payment Processing. Payments are processed by Stripe. Your payment card details are handled directly by Stripe and are never stored on our servers. By providing payment information, you also agree to Stripe's Terms of Service.

Failed Payments. If a payment fails, we may retry the charge and/or suspend access until payment is resolved. We will notify you of payment issues via email.

5. Refund Policy

We want you to be satisfied with the Service. If you are not, the following refund policy applies:

  • Monthly subscriptions: Refund requests may be submitted within 30 days of your initial purchase. After the 30-day window, no refunds are issued for remaining subscription time.
  • Lifetime plans: Refund requests may be submitted within 30 days of purchase.
  • Refunds are issued to the original payment method.
  • Refund requests should be sent to support@burtonmethod.com.

Unauthorized chargebacks (disputes filed with your bank without first contacting us) may result in suspension of your account and, if applicable, an administrative fee.

6. Intellectual Property

TBM Original Content. All video lessons, original explanations, transcripts, platform design, software, and other original materials are owned by The Burton Method or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Your License to Use. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Content through the Service for your personal educational purposes only. This license does not include the right to:

  • Copy, reproduce, distribute, or publicly display any Content.
  • Modify or create derivative works from any Content.
  • Sell, rent, loan, or sublicense any Content.
  • Record, screenshot, or capture video lessons or other media.
  • Summarize, paraphrase, or rewrite Content for distribution.

Your Content. You retain ownership of content you create through the Service, such as personal notes and study annotations. By using the Service, you grant us a limited license to store and process your content as needed to provide the Service.

7. LSAC Licensed Content

The Service includes LSAT questions and related materials used under license from the Law School Admission Council (LSAC). This content is subject to additional restrictions:

  • LSAC Licensed Content is the property of LSAC. Its inclusion in the Service does not imply LSAC's endorsement of The Burton Method.
  • LSAC Licensed Content is available only to users with an active paid subscription.
  • You may not copy, reproduce, redistribute, modify, or create derivative works from any LSAC Licensed Content.
  • You may not input, paste, or otherwise submit any LSAC Licensed Content (including question text, answer choices, or passages) into any artificial intelligence system, chatbot, or language model. This includes but is not limited to ChatGPT, Claude, Gemini, or any other AI tool.
  • LSAC Licensed Content is displayed with copyright attribution as required by our license agreement.

Violation of these restrictions may result in immediate termination of your account and may expose you to legal liability.

8. AI-Generated Content

Certain features of the Service use artificial intelligence to generate personalized study materials, including Learn Stream cards, practice scenarios, concept explanations, and homework feedback. You should be aware of the following:

  • AI-generated content is provided for educational purposes and may contain errors or inaccuracies. It is intended to supplement, not replace, structured LSAT preparation with our instructor-led video lessons.
  • We review and curate AI-generated materials, but do not guarantee their accuracy or completeness.
  • AI features use only TBM's original instructional content and anonymized performance metadata. LSAC Licensed Content is never processed by AI systems.
  • All answer-choice explanations for licensed LSAT questions are human-authored, not AI-generated.

9. Acceptable Use

You agree not to:

  • Share your account credentials or allow others to use your account.
  • Use the Service for any commercial purpose without our written authorization.
  • Scrape, crawl, or use automated tools to extract data from the Service.
  • Reverse engineer, decompile, or disassemble any part of the Service.
  • Attempt to access other users' accounts or data.
  • Upload malicious code, viruses, or other harmful material.
  • Interfere with the Service's operation or other users' experience.
  • Use the Service to develop a competing product or service.
  • Circumvent access controls, subscription requirements, or content protection measures.

10. Tutoring Services

The Service may offer one-on-one tutoring sessions with independent tutors. The following terms apply to tutoring:

  • Tutors set their own availability and hourly rates. Session payments are processed through Stripe.
  • Tutoring sessions may be recorded for quality and reference purposes. Both parties will be notified when recording is active.
  • Cancellation policies for individual sessions are displayed at the time of booking.
  • TBM facilitates the tutoring marketplace but does not guarantee specific outcomes from tutoring sessions.

11. Third-Party Services

The Service integrates with third-party services to provide its features. These include payment processing (Stripe), authentication (Supabase), hosting (Vercel), content delivery (Cloudflare), and others. Each third-party service operates under its own terms and privacy policies.

We are not responsible for the availability, content, or practices of third-party services. Links to external websites do not constitute our endorsement.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in the Privacy Policy.

13. Disclaimers

Please read this section carefully.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. To the fullest extent permitted by law, The Burton Method disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

  • The Service will be uninterrupted, error-free, or secure.
  • Any errors or defects will be corrected in a specific timeframe.
  • Your use of the Service will result in any particular LSAT score improvement, law school admission, or other outcome.
  • AI-generated content is accurate, complete, or suitable for any particular purpose.

LSAT preparation outcomes depend on many factors beyond our control. The Service provides educational tools and instruction, not guaranteed results.

14. Limitation of Liability

To the fullest extent permitted by law, The Burton Method and its officers, directors, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, lost profits, business interruption, LSAT score outcomes, or law school admission decisions, arising from your use of or inability to use the Service.

Our total liability for any claims arising under these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless The Burton Method and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your breach of these Terms.
  • Your misuse of the Service.
  • Your violation of any third-party rights.
  • Your violation of any applicable law or regulation.

16. Termination

By you. You may terminate your account at any time by canceling your subscription and contacting us to request account deletion.

By us. We may suspend or terminate your account at our discretion if we believe you have violated these Terms, including but not limited to: account sharing, redistribution of Content, misuse of LSAC Licensed Content, or abusive behavior.

Effect of Termination. Upon termination, your right to access the Service immediately ceases. We may delete your account data in accordance with our Privacy Policy.

Sections relating to Intellectual Property, LSAC Licensed Content, Disclaimers, Limitation of Liability, Indemnification, Dispute Resolution, and General Provisions survive termination.

17. Dispute Resolution

Informal Resolution. Before filing any formal claim, you agree to first contact us at support@burtonmethod.com and attempt to resolve the dispute informally for at least 30 days.

Binding Arbitration. If the dispute is not resolved informally, you and The Burton Method agree to resolve it through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in the state where The Burton Method is headquartered, or remotely if both parties agree.

Class Action Waiver. You and The Burton Method agree that disputes will be resolved on an individual basis only. Neither party may participate in a class action, class arbitration, or representative proceeding.

Small Claims Exception. Either party may bring qualifying claims in small claims court.

Opt-Out. You may opt out of the arbitration and class action waiver provisions by sending written notice to support@burtonmethod.com within 30 days of creating your account. Your notice must include your name, email address, and a clear statement that you wish to opt out.

18. General Provisions

Governing Law. These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and The Burton Method regarding the Service.

Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.

Assignment. We may assign our rights and obligations under these Terms. You may not assign yours without our written consent.

Force Majeure. We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, pandemics, or internet infrastructure failures.

Electronic Communications. By using the Service, you consent to receiving communications from us electronically, including emails and in-app notifications.
